If special conditions exist, we can
work out a settlement of your debts.
We can file a Chapter 7 bankruptcy.
This will wipe out your unsecured debts. An unsecured debt has no
collateral. Collateral is property that guarantees the payment of
the loan. If there is collateral, and you want to keep it, we can
arrange that. Not everyone can file this form of bankruptcy.
Some people may lose property. Some people earn too much money.
Some people need to stop a foreclosure. Chapter 7 is not for them.
We can file a Chapter 13 bankruptcy.
This places the debtor into a payment plan that is supervised by the
trustee and approved by the judge. These plans require monthly
payments for 3 to 5 years. This type of bankruptcy is appropriate
in circumstances:
- if you want to keep property that
would be lost in a Chapter 7;
- if you are behind in your mortgage
or real estate taxes and you want to keep your home;
- if you are relatively well-off, and
the court would oppose a Chapter 7.
We can file a Chapter 11 if you have a small corporation or a Chapter 12 if you are a farmer.
